Soms kan het ook de Kamer van Koophandel zijn of de notaris. Dat verschilt per consulaat. Als de ambassade alleen de geregistreerde handtekening van het Ministerie van Buitenlandse Zaken herkent, dan moet het document vooraf door het Ministerie van Buitenlandse Zaken gelegaliseerd (erkend) worden! Het document krijgt dus twee legalisaties.
Ons traject begint met de ontvangst van uw documenten. We controleren de documenten om er zeker van te zijn dat alles in orde is. Daarna starten we het traject, het afgeven en ophalen van uw documenten bij de juiste autoriteiten. Het doel is om de documenten uiteindelijk naar het consulaat van bestemming te brengen. Vaak duurt het meerdere dagen, omdat de afstanden en openingstijden van de instanties alleen ‘s ochtends toegankelijk zijn. Ook bij de ambassade is de legalisatie zelden dezelfde dag afgerond, omdat ze vaak ook alleen in de ochtend open zijn. Laat de legalisatie van documenten aanvragen.

Nee, zeker niet! Het ministerie van Buitenlandse Zaken kan alleen originele documenten van Nederlandse overheidsinstanties legaliseren (soms kunnen ze ook voor bepaalde landen buitenlandse documenten in het buitenland legaliseren).
Enkele voorbeelden: originele documenten van de gemeente, Kamer van Koophandel en alle andere Nederlandse ministeries.
Dat is moeilijk te zeggen omdat er veel verschillende soorten documenten zijn, maar onze specialisten weten wat ze met uw documenten moeten doen.

In bijna alle gevallen moeten documenten in het Engels worden ingediend. De kosten van de beëdigde vertaler – net als bij notarissen zijn exclusief btw. De kosten voor de beëdigde vertaler zijn variabel, omdat de kosten worden berekend voor het aantal vertaalde woorden.
De legalisatie vindt plaats doordat de notaris een verklaring plaatst onder uw handtekening, waarin hij uw handtekening voor echt verklaart. De verklaring van de notaris gaat vergezeld van zijn handtekening en ambtsstempel.
Als je een handtekening legaliseert of een document certificeert, biedt dit extra rechtszekerheid in het internationale handelsverkeer. Zo weet jouw buitenlandse klant bijvoorbeeld dat het document dat je hebt ondertekend rechtsgeldig is. Nadat KVK een document gecertificeerd heeft, heeft jouw leverancier de zekerheid dat een officiële instantie ernaar gekeken heeft.
KVK legaliseert de handtekening(en) op een document. Hiermee bevestigt KVK dat het document is ondertekend door iemand binnen het bedrijf die het document ook mag tekenen. Zo’n document is bijvoorbeeld een handelsfactuur. KVK legaliseert geen documenten die in strijd zijn met de wet. Denk hier aan documenten met teksten die gericht zijn tegen een geloof of ras. Ook legaliseert KVK geen documenten die een aantoonbare onwaarheid bevat. KVK legaliseert alleen de handtekening en niet de inhoud van het stuk.
Let op, de handtekening moet van de eigenaar of het bestuurslid van het bedrijf zijn! De naam en handtekening moeten geregistreerd zijn bij de Kamer van Koophandel.
Welke documenten niet? De KVK legaliseert niet haar eigen documenten. Dat zijn bijvoorbeeld uittreksels uit het Handelsregister of afschriften van een gedeponeerde jaarrekening van een bedrijf. Dit zijn al officiële KVK documenten en kunnen niet extra worden gelegaliseerd. Is er toch nog een extra legalisatie nodig van deze documenten? Biedt deze dan rechtstreeks aan bij het ministerie van Buitenlandse zaken.
Op deze vraag is maar één heel kort antwoord te geven: in Nederland alleen Nederlandse documenten en in België kunnen alleen Belgische documenten gelegaliseerd worden of een apostille krijgen. Ik zal het antwoord anders formuleren: De documenten die u wilt laten legaliseren of een apostille wilt plaatsen bij de ambassade van het land van bestemming kunnen alleen Nederlandse of Belgische documenten zijn!
Een voorbeeld: u heeft een Chinese geboorteakte uit China die u voor uw huwelijk in Nederland wilt gebruiken. U kunt niet naar het Nederlandse Ministerie van Buitenlandse Zaken gaan om een Chinese geboorteakte te laten erkennen (legaliseren).
Het Nederlandse Ministerie van Buitenlandse Zaken heeft geen idee of uw document al dan niet echt is.
U moet dus de Chinese geboorteakte in China laten legaliseren door de lokale overheid en misschien vertalen. Wanneer de Chinese overheid de Chinese geboorteakte heeft laten legaliseren, laat u deze legaliseren bij de Nederlandse ambassade in China. Daarna kunt u de geboorteakte pas in Nederland gaan gebruiken.
De reden is dat de Nederlandse ambassade in China het Chinese document – Chinese geboorteakte als echt heeft erkend.
